The Bombay High Court on Monday pulled up the State Crime Investigation Department (CID) for taking the probe into the custodial death of Akshay Shinde “lightly”. Shinde was the prime accused in the Badlapur assault case in which two kindergarten girls in a school in the district were sexually assaulted. He was shot dead by the police on September 24 this year.
A Division Bench of Justices Revati Mohite-Dere and Prithviraj K. Chavan raised concerns over the need for a fair probe into the encounter. The Bench said the CID’s conduct in the case “raises major concerns, doubts and a wrong inference” that the investigation agency does not want to submit all the information to the Magistrate conducting the inquiry into the encounter case.
The Bench observed, “Why is the CID not collecting information properly? Don’t test our patience now.”
The court slammed the State investigation agency and asked it to collect all important documents and submit them to the Magistrate. “Investigate the case properly and submit all statements properly to the Magistrate,” it said.
Noting that every case needs a fair investigation, the Bench posted the matter for further hearing on January 20, 2025, and asked the Magistrate to submit a comprehensive report to the court by then.
